Diamond Pet Food Class Action Lawsuit Settles For 3.1 Million
DogExplorer.com News - Diamond Pet Food has announced a settlement in the class action lawsuit claiming death or injury due to pet food contaminated with aflatoxin mold poisoning.
The settlement is modest as class action litigation goes with the total amount "of $3.1 million to pay for valid claims and for Court awarded attorneys’ fees, costs, and expenses," according to the settlement announcement released by Diamond Pet Food. Dog owners effected by this are cautioned to pay close attention to the term "valid claims."
Owners will have to prove their pets were injured by Diamond Pet Food and that they did not return the food for a refund from the store. The pet food poisoning settlement is also pending final court approval.
Additional provisions call for reimbursement of veterinary expenses if the dog was injured due to eating the contaminated Diamond Pet Food and treated by a veterinarian. Pet owners must review and submit several key documents and do so by important dates or they may not qualify for benefits under the class action litigation (see below the video for links to these resources - click "Read more").

If you do not want to be legally bound by the settlement, you must exclude yourself by March 16, 2008 or you will not be able to sue Diamond Pet Foods about these claims ever again. You must mail your exclusion request postmarked no later than March 16, 2008 to the following address:
